Lawyer wants indictment thrown out in Jackson County jail murder

MURPHYSBORO, Ill. -- The lawyer for a man suspected of killing his cellmate in the Jackson County jail wants to throw out the indictment.

Richard Powell faces charges in the death of his Collin Kotlarz while Powell was being held on a domestic battery charge in May 2016.

The domestic battery charge has since been dropped.

Powell's lawyer says an Illinois State Police investigator made misleading statements to the grand jury.

The judge did not make a ruling on the motion Friday, but plans to make one down the line.
