Murphysboro to sue Union Pacific over land dispute

MURPHYSBORO -- Murphysboro plans to sue Union Pacific railroad over a land dispute.

The railroad claims it owns property on N. 23rd street and even warned a homeowner that they were trespassing.

Mayor Will Stephens said he's never seen any proof to back up the railroad's claims. He also argued the city has been taking care of the property in question for several decades.

"This is one of the silliest things I've had to deal with since I've been mayor of Murphysboro," Stephens said. "If the railroad would just concede to our position, they would have no cost and they could still access that road all they needed to."

The council voted unanimously this week to file the lawsuit, seeking control of the property.

Stephens said there's some previous court cases that reinforce the city's arguments.
